ALIBI MARINA CANCELLATION POLICY 1. Cancellations received prior to the 15 days of your scheduled arrival date. No cancellation fee. 2. Cancellations received within 15 days of scheduled arrival date- one-half of the reservation period, one night minimum, will be charged to the credit card on file. 3. Cancellations received within 24 hours of scheduled arrival date full charge for the entire reservation period charged to the credit card on file. 4. Cancellations due to Small Craft Advisory are subject to the discretion of the Harbormaster and will generally be honored as a no charge cancellation. However, the Small Craft Advisory must be issued by the USCG in either your departure/arrival area the day of your reservation. All other reasons for cancellations are at the discretion of the Harbormaster. No refunds given for early departure. **************************** SPECIAL CONDITIONS AGREEMENT As a pre-condition to renting at the Alibi Marina or Harbor Guest House Marina, collectively " Marina" I agree that if for any reason I am unable to depart on the scheduled date I agree to any or all of the following at the sole discretion of the Harbormaster: Move to another location in the marina; permit another boat to raft off ours; raft off another boat or such other arrangements required by the Marina Staff in order to provide space for other boats that have previously reserved space or others in need of refuge. I agree to abide by the Rules and Regulations and Transient Rental Agreement which are posted below and will be provided to me at check in. SECTION 1: GENERAL CONTROL OF ALIBI MARINA A boat that enters the limits of the Marina shall be under the jurisdiction of the Marina and its designated representatives. The boat shall be maneuvered, moored and anchored strictly in accordance with the Rules and Regulations of the Marina. Marina may, at its sole option, properly secure any boat in the Marina which may, in the opinion of the Marina staff be improperly secured or unsecured. SECTION 2: BOAT OWNERS LIABILITY: INDEMNITY OF MARINA Boat owner covenants to exercise due care in the occupation of the mooring slip and to vacate the slip in good condition, normal wear and tear occasioned by normal use only excepted. Boat Owner shall indemnify and hold harmless Marina from and against all claims, actions, proceedings, damages, and liabilities, including actual attorney's fees, arising from or connected with Boat Owner's possession and use of the slip. SECTION 3: LIMITATION OF MARINA'S LIABILITY Boat Owner acknowledges that he or she has inspected the slip and is satisfied that the mooring space is adequate for safe mooring of his/her vessel. This contract is not a bailment of the Boat Owner's boat but a license to occupy a slip, and Marina's liability is limited to supervision and maintenance of the piers and waterfront area. Marina's employees will make reasonable efforts to contact Boat Owner and notify him or her of dangerous conditions requiring Boat Owner's attention, but Marina assumes no responsibility for tending mooring lines or moving boats from the slips to which they were assigned. SECTION 4: DAMAGE TO MARINA PROPERTY If damage to Marina property or any other boat located with the marina shall be caused by the act of neglect of Boat Owner, his/her agents or employees, or anyone operating the boat described herein, Marina may, at its option, repair such damage, whether caused to the premises of Marina or to the licensees or occupants thereof and Boat Owner shall thereupon reimburse Marina for the total cost of such damage, both for the premises of Marina and to the property of the licensees or occupants thereof, except to the extent that Marina shall be reimbursed for damage through insurance carried by Marina. SECTION 5: INSURANCE Boat owner hereby represents and warrants that he/she has secured and will maintain, during the term of the Agreement, such public liability insurance with limits acceptable to Marina and other insurance including fire and extended coverage adequate to protect Boat Owner from all loss, damage, or expense arising out of or in connection with the rental of mooring space in the marina known as Alibi Marina or Harbor Guest House Marina. Boat Owner agrees to provide Marina with a copy, if requested. I agree to abide by the stated terms in this agreement and the full set of Rules and Regulations for the marinas that will be provided to me at the time of check-in. These policies are effective as of 11/5/09 and are subject to change from time to time without notice. The boater should obtain a copy of any later version upon arrival at the marina.
